This End User License Agreement (“Agreement”) is between you and Aviation Dictionary and governs use of this app made available through the Apple App Store. By installing the Aviation Dictionary App, you agree to be bound by this Agreement and understand that there is no tolerance for objectionable content. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the App Name App. In order to ensure App Name provides the best experience possible for everyone, we strongly enforce a no tolerance policy for objectionable content. If you see inappropriate content, please use the "Report as offensive" feature found under each post.
Subject to the terms of this Agreement, Aviation Dictionary grants to you a limited, non-exclusive, non-transferable license, without right to sub-license, to use Aviation Dictionary in accordance with this Agreement and any other written agreement with its author ("Developer"). Aviation Dictionary does not transfer the title of Aviation Dictionary to you; the license granted to you is not a sale. This agreement is a binding legal agreement between the Aviation Dictionary and the purchasers or users of Aviation Dictionary.
Aviation Dictionary and the license herein granted shall be supported and maintained by its author. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to this agreement.
Aviation Dictionary and the license herein granted shall not be copied, shared, distributed, re-sold, offered for re-sale, transferred or sub-licensed in whole or in part except that you may make one copy for archive purposes only. For information about redistribution of Aviation Dictionary contact the Developer.
Aviation Dictionary, not Apple, shall be responsible for addressing any claims relating to the product/app which includes, but is not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection the app's use of the HealthKit and HomeKit frameworks.
Aviation Dictionary shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the Aviation Dictionary app. To the extent Aviation Dictionary is required to provide indemnification by applicable law, Aviation Dictionary, not Apple, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the Aviation Dictionary App or your use of it infringes any third party intellectual property right.
You represent and warrant that: (a) You are not located in a country that is subject to a United States Government embargo, or that is on Title 15, Part 740 Supplement 1 Country Group E of the United States Code of Federal Regulations; (b) You are not located in a country that has been designated by the United States Government as a “terrorist supporting” country; and (c) You are not listed on any U.S. Government list of prohibited or restricted parties. You further agree not to transport the Mobile App to or use the Mobile App in any such country.
You acknowledge and agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of this agreement, and that, upon the your acceptance of the terms and conditions of this agreemenr, Apple will have the right (and will be deemed to have accepted the right) to enforce this agreement against the you as a third party beneficiary thereof.
Your license to use Aviation Dictionary is limited to the number of licenses downloaded/purchased by you. You shall not allow others to use, copy or evaluate copies of Aviation Dictionary. Notify them to download a copy from their appropriate app store.
You shall use Aviation Dictionary in compliance with all applicable laws and not for any unlawful purpose. Without limiting the foregoing, use, display or distribution of Aviation Dictionary together with material that is pornographic, racist, vulgar, obscene, defamatory, libelous, abusive, promoting hatred, discriminating or displaying prejudice based on religion, ethnic heritage, race, sexual orientation or age is strictly prohibited.
Each licensed copy of Aviation Dictionary may be used on one single computer/mobile device location by one user. Use of Aviation Dictionary means that you have loaded, installed, or run Aviation Dictionary on a computer or similar device. If you would like to install Aviation Dictionary onto a multi-user platform, server or network, each and every individual user of Aviation Dictionary must be downloaded/purchased and/or licensed separately.
You may make one copy of Aviation Dictionary for backup purposes, providing you only have one copy installed on one computer being used by one person. Other users may not use your copy of Aviation Dictionary unless with your knowledge and approval. The assignment, sublicense, networking, sale, or distribution of copies of Aviation Dictionary are strictly forbidden without the prior written consent of the Developer. It is a violation of this agreement to assign, sell, share(*), loan, rent, lease, borrow, network or transfer Aviation Dictionary.

This Software contains copyrighted material, trade secrets and other proprietary material. You shall not, and shall not attempt to, modify, reverse engineer, disassemble or decompile Aviation Dictionary. Nor can you create any derivative works or other works that are based upon or derived from Aviation Dictionary in whole or in part.
The name, logo and graphics file that represents Aviation Dictionary shall not be used in any way to promote products developed with Aviation Dictionary. The Developer retains sole and exclusive ownership of all right, title and interest in and to Aviation Dictionary and all Intellectual Property rights relating thereto.
Copyright law and international copyright treaty provisions protect all parts of Aviation Dictionary, products and services. No program, code, part, image, audio sample, or text may be copied or used in any way by the user except as intended within the bounds of the single user program. All rights not expressly granted hereunder are reserved for the Developer.
You will indemnify, hold harmless, and defend Aviation Dictionary, the Developer, he's employees, agents and distributors against any and all claims, proceedings, demand and costs resulting from or in any way connected with your use of the Software.
In no event (including, without limitation, in the event of negligence) will the Developer , he's employees, agents or distributors be liable for any consequential, incidental, indirect, special or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of use, business interruption, loss of information or data, or pecuniary loss), in connection with or arising out of or related to this Agreement, the Software or the use or inability to use the Software or the furnishing, performance or use of any other matters hereunder whether based upon contract, tort or any other theory including negligence.
The Developer's entire liability, without exception, is limited to the customers' reimbursement of the purchase price of the Software (maximum being the lesser of the amount paid by you and the suggested price as listed by in the app store ) in exchange for the return of the product, all copies, registration papers and manuals, and all materials that constitute a transfer of license from the customer back to the Developer.
Except as expressly stated in writing, the Developer makes no representation or warranties in respect of this Software and expressly excludes all other warranties, expressed or implied, oral or written, including, without limitation, any implied warranties of merchantable quality or fitness for a particular purpose.
This Agreement shall be governed by the law of the Zambia applicable therein. You hereby irrevocably attorn and submit to the non-exclusive jurisdiction of the courts of Zambia therefrom. If any provision shall be considered unlawful, void or otherwise unenforceable, then that provision shall be deemed severable from this License and not affect the validity and enforceability of any other provisions.
In-App Purchases are purchased from and billed by Apple Inc., not Aviation Dictionary. These purchases are subject to the terms and conditions of Apple Inc. All billing and refund inquiries must be directed to Apple Inc. Aviation Dictionary does not have access to Apple Inc. accounts or transactions. If you wish to confirm the type of subscription that has been purchased from Apple Inc. please consult your Apple account or receipt as each subscription will have a unique billing name.
The Weekly purchase (billed as " Aviation Dictionary Pro - 1 Week") is valid for one week and will be re-billed every week by Apple Inc. until cancelled by the user.
The Monthly purchase (billed as " Aviation Dictionary Pro - 1 Month") is valid for one month and will be re-billed every month by Apple Inc. until cancelled by the user.
The Yearly purchase (billed as " Aviation Dictionary Pro - 1 Year") is valid for one year and will be re-billed every year by Apple Inc. until cancelled by the user.
Apple Inc. will send an email well in advance of renewal containing a hyperlink to manage the respective purchased subscription. Apple subscriptions can be managed from a mobile device or computer that uses the same Apple ID as the initial purchase. Aviation Dictionary cannot manage Apple subscriptions.
Any failure to comply with the terms and conditions of this Agreement will result in automatic and immediate termination of this license. Upon termination of this license granted herein for any reason, you agree to immediately cease use of Aviation Dictionary and destroy all copies of Aviation Dictionary supplied under this Agreement. The financial obligations incurred by you shall survive the expiration or termination of this license.
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. The responsibility for ensuring that the information given by this Software is valid, correct and accurate enough for your purposes lies entirely with you the user. Aviation Dictionary is not approved by the CAA, FAA, ICAO or any other authorities and therefore Aviation Dictionary, the author and distributors WILL NOT be liable for any indirect, special, incidental, or consequential costs, expenses, or damages arising out of the use, misuse or the inability to use, Aviation Dictionary.
